1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Talking Points application ("App") and related services operated by Parris Image, LLC dba Sycamor Studio ("we," "us," or "our"). By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, solely for your personal or professional use.
You may not: copy, modify, or distribute the App; reverse engineer or attempt to extract the source code; sublicense or sell access to the App; or use the App in any way that violates applicable law.
3. Subscriptions and Purchases
The App offers free and paid subscription tiers. Paid features ("Pro") are available via monthly or annual subscriptions, or a one-time Lifetime purchase, processed through the Apple App Store.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your Apple ID account settings.
- We do not process payments directly — all billing is handled by Apple.
- Refunds are subject to Apple's refund policies.
- Lifetime purchases are a one-time payment for perpetual access to Pro features as they exist and evolve over time.
4. Your Content
You retain full ownership of all talking points, notes, and documents you create in the App ("Your Content"). You grant us no rights to Your Content. We do not access, view, or use Your Content for any purpose.
You are solely responsible for Your Content and represent that you have all rights necessary to use it within the App.
5. Speech Recognition
The App uses Apple's Speech Recognition framework. By using speech features, you agree to Apple's terms for that service. We do not control Apple's speech recognition infrastructure and are not responsible for its accuracy or availability.
6. Acceptable Use
You agree not to use the App to:
- Violate any applicable law or regulation
- Infringe the intellectual property rights of others
- Transmit malicious code or interfere with the App's operation
- Attempt to gain unauthorized access to any systems
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SPEECH RECOGNITION WILL BE ACCURATE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYCAMORE APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time. Upon termination, your license ends, but these Terms otherwise survive.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of [Your County], [Your State].
